Terms & Conditions
1. Definitions

Company means Trinity Kitchens and Granite
-
Client means the person or entity accepting the quotation
-
Works means all cabinetry, stone, renovation, plumbing, electrical, and associated services
2. Scope of Works
All works will be carried out in accordance with:
-
Approved quotation
-
Signed plans and drawings
-
Confirmed selections and specifications
Any items not expressly included are excluded.
3. Quotations
-
Quotations are based on information available at the time of pricing.
-
Plumbing and electrical works are estimates only and provided as a general description.
-
Costs may vary where site conditions differ from those reasonably anticipated.
4. Variations
-
Any work outside the agreed scope is a variation.
-
Variations may arise from:
-
Client-requested changes
-
Site or structural conditions
-
Plumbing/electrical requirements identified during works
-

All variations will be charged in addition to the contract price.
-
The Client agrees that any additional work will be back charged accordingly, whether approved verbally, in writing, or required to complete the works.
5. Plans, Selections & Approvals
-
All plans and selections must be approved in writing prior to ordering or manufacture.
-
Colour selections, finishes, and materials are final once confirmed in writing.
6. Changes After Approval
-
Changes after sign-off and/or ordering will incur additional costs, including:
-
Redesign and administration
-
Material wastage and reordering
-
Labour and scheduling impacts
-
-
Timeframes may be extended accordingly.
7. Site Conditions
The Client must ensure:
-
Safe and clear access
-
Site readiness for works
-
Completion of prerequisite works
Any additional work required due to site conditions will be charged as a variation.
8. Plumbing & Electrical Works
-
Works are based on visible conditions only.
-
Any additional work required due to hidden issues, non-compliance, relocations, or upgrades will be treated as a variation and charged accordingly.
9. Cabinetry Works
-
Cabinetry will be manufactured in accordance with approved plans.
-
Minor adjustments may be required due to site conditions.
-
The Company is not responsible for building movement or pre-existing structural irregularities.
-
Colours are not true to website or brochures as per manufacturer's terms and conditions- please take samples home to see in your home lighting- larger samples availble on request
10. Stone Works
-
Stone products may vary in colour, pattern, and finish.
-
Joins are unavoidable and completed in accordance with industry standards.
-
Industry tolerances apply, including minor variation in alignment and finish.
11. Templating & Installation
-
Templating will only occur after cabinetry is installed and deposit paid.
-
Installation dates are estimates only and subject to supply and scheduling.
-
Delays outside the Company’s control may occur.
12. Access, Delays & Rescheduling
-
The Client must provide access at agreed times.
-
If works cannot proceed due to site readiness, access, or materials:
-
Additional charges may apply
-
Works may be rescheduled
-
13. Practical Completion
Practical Completion is reached when the Works are substantially complete and are reasonably capable of being used for their intended purpose, despite minor defects or incomplete items that do not prevent normal use.
-
Practical Completion will be determined by the Company.
-
Minor defects, omissions, or outstanding items (including cosmetic imperfections or touch-ups) do not prevent Practical Completion.
-
A defects list (“punch list”) may be created and agreed upon at or after Practical Completion.
Upon Practical Completion:
-
The Client must make final payment in full in accordance with the contract.
-
The Works may be handed over to the Client for use.
The Company will rectify any agreed defects within a reasonable timeframe.
Failure by the Client to attend inspection, or continued use/occupation of the Works, will be deemed acceptance of Practical Completion.
Practical Completion is not conditional on the completion of minor items, third-party works, or delays outside the Company’s control.
14. Payments

A deposit is required prior to commencement or ordering.
-
Progress payments may be issued at the Company’s discretion.
-
Final payment is due upon Practical Completion or prior to handover.
15. Payment Enforcement

All invoices must be paid by the due date stated on the invoice.
-
Late payments may incur:
-
Interest at a reasonable commercial rate
-
Administrative and recovery costs
-
-
The Company reserves the right to:
-
Suspend works
-
Withhold completion or handover
-
Engage debt recovery or legal action
-
All recovery costs (including legal and collection fees) are payable by the Client.
16. No Withholding of Payment
-
The Client is not entitled to withhold payment due to:
-
Minor defects
-
Incomplete items not preventing reasonable use
-
Disputes regarding variations or scope
-
-
Concerns must be raised in writing, and the Company must be given reasonable opportunity to inspect and rectify.
-
Payment obligations remain enforceable regardless of dispute and must be addressed separately.
17. Damage & Liability

The Company will rectify damage directly caused by its works.
-
The Company is not liable for:
-
Third-party damage
-
Pre-existing conditions
-
Client-supplied materials
-
Indirect or consequential loss
-
18. Warranty
-
Workmanship is provided in accordance with Australian Consumer Law.
-
Warranty excludes:
-
Normal wear and tear
-
Structural movement
-
Misuse or lack of maintenance
-
Works altered by others
-
19. Cancellations
-
Cancellation after acceptance may result in:
-
Loss of deposit
-
Charges for materials, labour, and administration incurred
-
20. Acceptance
By accepting this quotation, the Client confirms:
-
All plans and selections are correct
-
They understand and accept these Terms & Conditions
-
They acknowledge that variations and additional costs may apply
21. Contact throughout Project

Outside hours contact project manager only between the hours of 0700-1700
-
Urgent messages will be responded to as soon as practicable within one business day and all other requests within two business days.

22. Governing Law
This agreement is governed by the laws of Western Australia.
